1. Definitions

In these Terms and Conditions, the following terms have the meanings set out below:

• "Chom Suan" / "we" / "us" — the senior living property operated at 34/1 Moo 3, Rawai, Mueang Phuket, Phuket 83130, Thailand
• "User" / "you" — any person accessing this website or communicating with Chom Suan in relation to residency or services
• "Resident" — a person who has entered into a residency agreement with Chom Suan
• "Services" — the accommodation, meals, housekeeping, and optional programmes offered by Chom Suan
• "Agreement" — these Terms and Conditions together with any residency or programme agreement signed between the parties

2. Acceptance of Terms

By accessing our website or submitting an enquiry, you confirm that you have read and accept these Terms and Conditions. If you do not agree with any part of these terms, please refrain from using this website or engaging our services.

Our services are intended for adults aged 18 and over. Individuals under 18 are not permitted to enter into agreements with Chom Suan.

3. Description of Services

Chom Suan is a non-medical senior living residence. We offer residential accommodation, daily meals, housekeeping services, and optional engagement programmes. We are not a licensed medical facility, nursing home, or healthcare provider. Our services do not include clinical care, medication management, or medical supervision.

Service availability is subject to capacity. Chom Suan reserves the right to decline or discontinue a residency where the needs of an individual fall outside the scope of our non-medical offering.

4. Residency Terms

4.1 Residency Agreement

A separate residency agreement will be provided to each resident prior to move-in. That agreement governs the terms of accommodation, pricing, notice periods, and the respective rights and obligations of both parties.

4.2 Room Allocation

Villa units are allocated by Chom Suan based on availability and suitability. We will discuss options with prospective residents and aim to accommodate preferences where possible.

4.3 Notice Period

Specific notice terms for ending a residency will be set out in the individual residency agreement. Generally, either party may end the arrangement with agreed written notice.

5. Pricing and Payment

Current service pricing is set out on our website and in any programme documentation provided. All prices are quoted in Thai Baht (฿). Applicable taxes and any additional charges will be clearly communicated in advance.

Payment terms, methods, and schedules are outlined in the individual residency or programme agreement. Chom Suan reserves the right to adjust pricing with reasonable advance notice.

Refund terms for optional programmes such as the Transition Adjustment Program or Cultural Calendar will be specified in the relevant programme agreement.

6. User Responsibilities

When using this website or communicating with Chom Suan, you agree to:

• Provide accurate and complete information in all enquiries and forms
• Not use this website for any unlawful purpose
• Not attempt to disrupt or compromise the website's operation
• Treat all Chom Suan staff and residents with respect and dignity

7. Intellectual Property

All content on this website — including text, images, layout, and design elements — is the property of Chom Suan or used with appropriate permission. You may not reproduce, distribute, or republish any part of this website without our prior written consent. Personal, non-commercial reference use is permitted.

8. Disclaimers

Our website is provided for informational purposes. While we take care to ensure accuracy, we do not warrant that all information is complete or current at all times. We are not liable for decisions made on the basis of website content alone.

Chom Suan does not make representations about health outcomes, life quality improvements, or specific results from residency. Our programmes and services are designed with residents' wellbeing in mind, but individual experiences will differ.

9. Limitation of Liability

To the extent permitted by Thai law, Chom Suan's total liability in connection with the services is limited to the fees paid by the relevant resident in the three months preceding the claim. We are not liable for indirect, incidental, or consequential losses.

Nothing in these terms limits liability for death or personal injury caused by our negligence, or for any liability that cannot be excluded by law.

10. Indemnification

You agree to indemnify Chom Suan against any claims, losses, or damages arising from your breach of these terms, misuse of our website, or provision of inaccurate information.

11. Termination

Chom Suan may end your access to this website or any agreement with immediate effect if you breach these terms, act in a manner harmful to other residents or staff, or if a resident's care needs exceed what our non-medical service can appropriately provide.

12. Governing Law and Disputes

These Terms and Conditions are governed by the laws of Thailand. Any disputes arising from or connected to these terms shall first be subject to good-faith informal resolution. If informal resolution is unsuccessful, disputes shall be referred to the courts of Phuket Province, Thailand.

13. General Provisions

• Entire Agreement: These terms, together with any residency or programme agreement, represent the full agreement between the parties on the relevant matter.
• Severability: If any provision is found to be unenforceable, the remaining provisions remain in full effect.
• Waiver: Failure to enforce any provision does not constitute a waiver of the right to do so in future.
• Notices: Formal notices should be sent to our address or to [email protected].

14. Changes to These Terms

We may update these terms from time to time. The updated version will be posted on this page with a revised effective date. Continued use of the website or services after changes are posted constitutes acceptance of the revised terms.
